ACCEPTABLE USE POLICY
This Acceptable Use Policy document, including the following list of Prohibited Activities, is an integral part of your Hosting Agreement with SimpliServers. If you engage in any of the activities prohibited by this AUP document SimpliServers may suspend or terminate your account.
SimpliServers's Acceptable Use Policy (the "Policy") for SimpliServers Services is designed to help protect SimpliServers, SimpliServers's customers and the Internet community in general from irresponsible or, in some cases, illegal activities. The Policy is a non-exclusive list of the actions prohibited by SimpliServers. SimpliServers reserves the right to modify the Policy at any time, effective upon posting at https://simpliservers.com/policies/aup. NOTE: We do our best to respect Law of the Land when it comes to content hosted within our services. If you have questions about our policies, feel free to contact our support team.
1.0 Abuse Definitions:
1.1 Resource Abuse:
1.1.1 Such resource abuse consists of any intentional or/and unintentional activity that consumes sufficient system resources, which may impact our hardware or other clients on the node.
1.2 Malicious Content:
1.2.1 Any code, script, program or else that is capable of performing harmful action to either customer on our platform or other systems are not allowed.
1.2.2 Any content that violates laws of your country, laws of countries where the content is served or laws of the country where your server is hosted are not allowed to be hosted on our platform.
1.2.3 Knowingly or repeatedly hosting such malicious content will result in a permanent ban from our platform, without any options to appeal or request a refund.
1.2.4 You must respect AUP from our providers. If you are unsure
about any content, please contact us before ordering service with us.
1.3 Unsolicited Communications
1.3.1 We do not allow any kind of unsolicited information or/and content or/and communication to be sent from our networks if you do not have consent from the recipient.
1.3.2 Knowingly or repeatedly performing unsolicited communication will result in a permanent ban from our platform, without any options to appeal or request a refund.
2.0 Post-abuse actions
2.1 Unintentional Abuse
2.1.1 Unintentional abuse is defined by Abuse Definitions section. It means that the customer didn't knowingly install software capable of performing abuse actions.
2.1.2 We believe that not all abuses are intentional. Some can happen unintentionally by installing compromised software.
2.1.3 In cases of unintentional abuse, server is suspended and the user has 48 hours to respond to an abuse ticket which was created after the abuse was detected by our systems. If the user doesn't respond within a specified time frame to such request their services are terminated.
2.1.4 In cases of unintentional abuse clients may reorder their services as we do not suspend the web hosting account.
2.1.5 Please note that we have full right to decide what is intentional and unintentional abuse. We reserve a right to still classify abuse as intentional.
2.2 Intentional Abuse
2.2.1 Intentional abuse is defined by Abuse Definitions section. It means that the customer did knowingly install software capable of performing abuse actions.
2.2.2 In cases of intentional abuse, ALL client's servers are immediately is suspended and the user has 24 hours to respond to an abuse ticket which was created after the abuse was detected by our systems.
2.2.3 If the user doesn't respond within a specified time frame to such request their services are terminated and their account is pernamently banned from our platform.
3.0 TOR & VPN Networks:
3.1.0 TOR Networks:
3.1.1 While we are supporters of Freedom of Speech and Anti Censorship, due to hosting policies from our providers we cannot allow any TOR networks to be hosted on our network. That includes Exit, Bridge or Relay nodes. We are actively working on this to allow such software to be hosted.
3.1.2 If we detect TOR patterns originating from your node, we will need to suspend your server, as this may be a violation of our provider's policies. Again, we are actively working on this to get it supported.
3.2.0 VPN Networks:
3.2.1 We allow you to host as well as take advantage of our VPN installation templates to host private VPNs, used for personal use.
3.2.2 You may not host public, shared, commercial or paid VPNs on our platform. Such services will be immediately suspended.
3.2.3 You may not use our server host VPN servers that access TOR network or are used for other malicious activities.
4.0 Additional terms and explanations (what we do not allow):
4.1.0 Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat or violates export control laws.
4.2.0 Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this AUP or the AUP of any other Internet Service Provider, which includes, but is not limited to, the facilitation of the means to send Unsolicited Bulk Email, initiation of pinging, flooding, mail-bombing, denial of service attacks is not allowed.
4.3.0 Operating an account on behalf of, or in connection with, or reselling any service to, persons or firms listed in the Spamhaus Register of Known Spam Operations (ROKSO) database at www.spamhaus.org/rokso.
4.4.0 Making unauthorized attempts by a user to gain access to any account or computer resource not belonging to that user (e.g., "cracking").
4.5.0 Efforts of trying to obtain or attempting to obtain service by any means or device with intent to avoid payment are not allowed.
4.6.0 You may not gain unauthorized access, alteration, destruction, or any attempt thereof, of any information of any SimpliServers customers or end-users by any means or device.
4.7.0 Knowingly engage in any activities designed to harass, or that will cause a denial-of-service (e.g., synchronized number sequence attacks) to any other user whether on the SimpliServers network or another provider's network are also not allowed.
4.8.0 You may not use SimpliServers's Services to interfere with the use of the SimpliServers network by other customers or authorized users.
4.9.0 We do not allow adult content to be served on our networks.
4.10.0 You may not resell our services without our permission.
4.11.0 You may not cause harm or affect other users on our platform.
4.12.0 We will respond and forward all legal orders to respective organs.
4.13.0 We may refuse to host your content if we deem, that it will be used for any of the prohibited purposes.
